All payment options offered by us and our hosting provider for our digital assets comply with the PCI DSS (Payment Card Industry Data Security Standard) regulations of the PCI Security Standards Council (Payment Card Industry Security Standards Council). This is a collaboration between brands such as Visa, MasterCard, American Express, and Discover. PCI DSS requirements help ensure the secure handling of credit card data (including physical, electronic, and procedural measures) by our store and service providers.

Notwithstanding the measures and efforts taken by us and our hosting provider, we cannot and do not guarantee absolute protection and security of the data you upload, publish, or otherwise share with us or others.

1. Ccope of application

The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.

For Germany, the following applies: According to § 13 BGB (German Civil Code), consumers are any natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

For Austria: In the following terms and conditions, “consumer” refers to the “consumer” within the meaning of the Consumer Protection Act (KSchG).

For Switzerland: In the following terms and conditions, “consumer” refers to the “consumer” as defined by Swiss law.

For entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contractual partners, conclusion of contract, correction options

The purchase contract is concluded with MathiasWehrMusic.

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. By clicking on the order button, you are submitting a binding offer for the products contained in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been submitted. A purchase contract is only concluded when we ship the ordered product to you and confirm the shipment to you with a second email.

We will store the contract text and send you the order details and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.

4. Subject matter of the contract

4.1 Product description 

Please note that the respective product description is an essential part of the contract.

4.2 Product images 
Notwithstanding your statutory warranty rights, we would like to draw your attention to the following special features. If you have any questions, please contact us: Due to individual screen configurations (e.g., resolution and brightness), slight deviations between the colors shown and the actual product colors are possible.

In the case of wooden products, natural variations in the grain, structure, and color of the wood are possible.

4.3 License to use digital content
The digital content offered is protected by copyright. You will receive a license to use each piece of digital content purchased from us from the respective licensor. The type and scope of the license to use are specified in the license terms stated in the respective offer.

Unless otherwise stated in the respective offer, you will receive a simple license. This includes a non-exclusive, unlimited right of use, in particular the permission to save and/or print a copy of the digital content for your personal use on your computer or other electronic device.

You are not entitled to rent out the contractual digital content or parts thereof, or to sublicense it, either for a fee or free of charge, or to make it accessible in any other way or otherwise make it available to third parties.

5. Requirements and handling of customer content

5.1 Requirements 
If it is necessary for the fulfillment of the order that you transmit content (e.g., texts, data, files) to us, the technical possibilities available for this and any applicable requirements are governed by the respective product description. You are solely responsible for the content, including the legality and accuracy of the content you transmit. We do not check the content or editorial aspects before executing the order.

5.2 Compliance with applicable law 
The content and the products to be created from it must always comply with the applicable legal provisions. In particular, they must not infringe any rights or claims of third parties (in particular copyrights, trademarks, or other property rights) and must not contain or serve any content that glorifies violence, is discriminatory, racist, xenophobic, or otherwise immoral or unconstitutional.

5.3 Indemnification 
You shall indemnify us against any claims by third parties that they may assert in connection with an infringement of their rights through our contractual use. In doing so, you shall also bear the necessary costs of legal defense, including all court and attorney's fees in the statutory amount. The indemnification shall not apply if you are not responsible for the infringement. In the event of a claim by a third party, you are obliged to provide us immediately, truthfully, and completely with all information necessary for the examination of the claims and a defense.

5.4 Right of withdrawal 
We reserve the right to refuse the order or withdraw from the contract if the content you have provided for this purpose violates legal or official prohibitions or offends common decency, or if there is reasonable suspicion of this. This applies in particular to the provision of content that is anti-constitutional, racist, xenophobic, discriminatory, offensive, harmful to minors, and/or glorifies violence.

6. Terms of delivery

We ship the products to the delivery address specified during the ordering process.

We only deliver by mail. Unfortunately, it is not possible to pick up the goods yourself.

7. Payment

7.1 Prices 
The prices stated at the time of ordering apply. These are total prices and include statutory value added tax.

Price fixing and price changes
In accordance with legal provisions, prices for books and sheet music in Germany are subject to fixed book prices (BuchPrG). This means that all price-fixed items sold by us must be offered at the price set by the publisher. We strive to always offer you the most up-to-date prices.

However, if the publisher changes the price after you have placed your order but before the goods have been delivered, we will inform you of this change immediately by email and ask for your agreement to the new price. If you do not agree to the price increase, we offer you the option of canceling your order free of charge.

We understand that price changes can cause inconvenience and are committed to making them as transparent and customer-friendly as possible.

7.2 Due date and default of payment 
The price is due upon conclusion of the contract, unless a later date is specified in the following terms of payment.

In the event of default of payment, we reserve the right to transfer the data to our debt collection service provider in order to collect the claim. Further claims remain unaffected by this.


7.3 Payment methods 
The following payment methods are generally available in our shop.​

Credit card
You enter your credit card details during the ordering process. 
Your card will be charged immediately after placing the order.​

PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction.

The payment transaction will be carried out by PayPal immediately after placing the order. You will receive further information during the ordering process.

PayPal may offer registered PayPal customers selected according to its own criteria additional payment options in their customer account. However, we have no influence on the offering of these options; additional payment options offered individually affect your legal relationship with PayPal. You can find more information on this in your PayPal account.

Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the Safari browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out immediately after the order is placed. You will receive further information during the ordering process.

8. Right of withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the withdrawal policy. Entrepreneurs are not granted a voluntary right of withdrawal.

9. Retention of title

The product remains our property until full payment has been made. 
For customers based in Switzerland, we are entitled to make a corresponding entry in the retention of title register.

The following also applies to entrepreneurs: We retain ownership of the product until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from this resale in the amount of the invoice amount, irrespective of whether the goods subject to retention of title are combined or mixed with a new item, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations. At your request, we will release the securities to which we are entitled to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.

10. Transportschäden

Für Verbraucher gilt: Werden Waren mit offensichtlichen Transportschäden angeliefert, so reklamieren Sie solche Fehler bitte möglichst sofort beim Zusteller und nehmen Sie bitte unverzüglich Kontakt zu uns auf. Die Versäumung einer Reklamation oder Kontaktaufnahme hat für Ihre gesetzlichen Ansprüche und deren Durchsetzung, insbesondere Ihre Gewährleistungsrechte, keinerlei Konsequenzen. Sie helfen uns aber, unsere eigenen Ansprüche gegenüber dem Frachtführer bzw. der Transportversicherung geltend machen zu können.

Für Unternehmer gilt: Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung geht auf Sie über, sobald wir die Sache dem Spediteur, dem Frachtführer oder der sonst zur Ausführung der Versendung bestimmten Person oder Anstalt ausgeliefert haben.

11. Datensicherung

Sie sind zur ordnungsgemäßen und regelmäßigen Sicherung Ihrer Daten verantwortlich. Bei Schäden aus dem Verlust von Daten, haften wir nicht, soweit Sie den Datenverlust durch eine regelmäßige und vollständige Datensicherung hätten vermeiden können. Die vorstehende Einschränkung gilt nicht für Ansprüche aufgrund von Schäden, die durch uns, unsere gesetzlichen Vertreter oder Erfüllungsgehilfen verursacht wurden   bei Verletzung des Lebens, des Körpers oder der Gesundheit bei vorsätzlicher oder grob fahrlässiger Pflichtverletzung sowie Arglist bei Verletzung wesentlicher Vertragspflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner regelmäßig vertrauen darf (Kardinalpflichten) im Rahmen eines Garantieversprechens, soweit vereinbart, oder soweit der Anwendungsbereich des Produkthaftungsgesetzes eröffnet ist.

12. Gewährleistung und Garantien

12.1 Mängelhaftungsrecht 
Gegenüber Verbrauchern mit Sitz in Deutschland und Österreich gilt: Es gilt das gesetzliche Mängelhaftungsrecht.

Für Verbraucher mit Sitz in der Schweiz gilt: Sie sollen, sobald es nach dem üblichen Geschäftsgange tunlich ist, die Beschaffenheit der empfangenen Sache prüfen und, falls sich Mängel ergeben, für die der Verkäufer Gewähr zu leisten hat, diesem sofort Anzeige machen.

Versäumt dieses der Verbraucher, so gilt die gekaufte Sache als genehmigt, soweit es sich nicht um Mängel handelt, die bei der übungsgemässen Untersuchung nicht erkennbar waren. Ergeben sich später solche Mängel, so muss die Anzeige sofort nach der Entdeckung erfolgen, widrigenfalls die Sache auch rücksichtlich dieser Mängel als genehmigt gilt. Senden Sie das mangelhafte Produkt mit einer Mangelbeschreibung an uns zurück. Sie tragen die anfallenden Transportkosten. Wir leisten Gewähr durch die Behebung von Mängeln. Dies geschieht nach unserer Wahl entweder durch Beseitigung des Mangels (Nachbesserung) oder Lieferung einer mangelfreien Sache (Ersatzlieferung). Schlägt die Nacherfüllung fehl, sind Sie zum Rücktritt vom Vertrag berechtigt. Dies gilt nicht im Falle unerheblicher Mängel. Ein Recht auf Preisminderung ist ausgeschlossen.
Gegenüber Unternehmern und unter Kaufleuten gilt: Soweit nicht nachstehend ausdrücklich anders vereinbart, gilt das gesetzliche Mängelhaftungsrecht. Die nachstehenden Einschränkungen und Fristverkürzungen gelten nicht für Ansprüche aufgrund von Schäden, die durch uns, unsere gesetzlichen Vertreter oder Erfüllungsgehilfen verursacht wurden

  • bei Verletzung des Lebens, des Körpers oder der Gesundheit

  • bei vorsätzlicher oder grob fahrlässiger Pflichtverletzung sowie Arglist

  • bei Verletzung wesentlicher Vertragspflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner regelmäßig vertrauen darf (Kardinalpflichten)

  • im Rahmen eines Garantieversprechens, soweit vereinbart, oder

  • soweit der Anwendungsbereich des Produkthaftungsgesetzes eröffnet ist.

Beschränkungen gegenüber Unternehmern 
Gegenüber Unternehmern gelten als Vereinbarung über die Beschaffenheit der Ware nur unsere eigenen Angaben und die Produktbeschreibungen des Herstellers, die in den Vertrag einbezogen wurden; für öffentliche Äußerungen des Herstellers oder sonstige Werbeaussagen übernehmen wir keine Haftung. Für Unternehmer beträgt die Verjährungsfrist für Mängelansprüche bei neu hergestellten Sachen ein Jahr ab Gefahrübergang. Der vorige Satz gilt nicht bei einer Sache, die entsprechend ihrer üblichen Verwendungsweise für ein Bauwerk verwendet worden ist und dessen Mangelhaftigkeit verursacht hat. Der Verkauf gebrauchter Waren erfolgt unter Ausschluss jeglicher Gewährleistung. Die gesetzlichen Verjährungsfristen für den Rückgriffsanspruch nach § 445a BGB bleiben unberührt. Hinweis gegenüber Kaufleuten Unter Kaufleuten gilt die in § 377 HGB geregelte Untersuchungs- und Rügepflicht. Unterlassen Sie die dort geregelte Anzeige, so gilt die Ware als genehmigt, es sei denn, dass es sich um einen Mangel handelt, der bei der Untersuchung nicht erkennbar war. Dies gilt nicht, falls wir einen Mangel arglistig verschwiegen haben.

13. Haftung

Für Ansprüche aufgrund von Schäden, die durch uns, unsere gesetzlichen Vertreter oder Erfüllungsgehilfen verursacht wurden, haften wir stets unbeschränkt  bei Verletzung des Lebens, des Körpers oder der Gesundheit, bei vorsätzlicher oder grob fahrlässiger Pflichtverletzung, bei Garantieversprechen, soweit vereinbart, oder soweit der Anwendungsbereich des Produkthaftungsgesetzes eröffnet ist.  Bei Verletzung wesentlicher Vertragspflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner regelmäßig vertrauen darf, (Kardinalpflichten) durch leichte Fahrlässigkeit von uns, unseren gesetzlichen Vertretern oder Erfüllungsgehilfen ist die Haftung der Höhe nach auf den bei Vertragsschluss vorhersehbaren Schaden begrenzt, mit dessen Entstehung typischerweise gerechnet werden muss.  Im Übrigen sind Ansprüche auf Schadensersatz ausgeschlossen.

14. Streitbeilegung

Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit, die Sie hier finden.
Zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle sind wir nicht verpflichtet und nicht bereit.

15. Schlussbestimmungen

Sind Sie Unternehmer, dann gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.
Sind Sie Kaufmann im Sinne des Handelsgesetzbuches, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen, ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus Vertragsverhältnissen zwischen uns und Ihnen unser Geschäftssitz.

Sollten einzelne Klauseln dieser AGB ganz oder teilweise unwirksam sein, so bleibt der Vertrag im Übrigen wirksam. Soweit einzelne Klauseln unwirksam sind, richtet sich der Inhalt des Vertrags nach den gesetzlichen Vorschriften.
